HEALTH WAIVER

If you answered YES to any questions on the HEALTH WAIVER Form, you are advised to seek medical advice/approval before commencing an exercise induction or program.

I acknowledge that:

  • If I answer YES to any questions on the HEALTH WAIVER questionnaire, I should seek medical advice/approval before commencing an exercise program and/or induction

  • If I wish to continue without such advice, I do so entirely at my own risk

  • I have read, fully understood, and answered the questions honestly

  • My Pilates Instructor cannot be held responsible for any injuries or ill health arising from my participation in the exercise program

AGREEMENT

Please read this agreement carefully as it forms the legal relationship between Lytham Pilates, director/owner Jessica Fell and Pilates Instructors working for Lytham Pilates, 1-3 Wood St, Lytham St. Annes, Lancashire, FY8 1QS ('we' or 'us') and you.

This document will constitute a legally binding agreement between us when you:

  • Sign this agreement, or

  • Attend the first class or session, or

  • Book and pay online and receive your confirmation

The terms and conditions below are set out to help you to enjoy, benefit from, and safely participate in your Pilates sessions in-person, online, and any recorded content.

MEDICAL DISCLAIMER

  • We are not medical professionals and cannot advise on whether you should join a class

  • If you have any health concerns about undertaking classes, consult your doctor or medical professional

  • You must notify us of any medical conditions and complete your health waiver accurately

  • We reserve the right to require you to leave a class if we have concerns about your health or ability to participate

  • You understand that when participating in any exercise program, there is a possibility of physical injury

  • You agree that participation is at your own risk, and you assume all risk of injury to yourself

  • You are responsible for exercising within your limits and seeking appropriate attention and advice

SUITABLE ATTIRE

  • Fitted clothing that allows free movement is required

  • Socks must be worn at all times

  • No loose garments, zips, studs, or jewelry should be worn on Pilates equipment to prevent damage

  • Long hair should be tied back

  • Shoes must be removed immediately upon arrival for in-studio classes

  • We reserve the right to require you to leave if not properly attired

PAYMENTS, CANCELLATIONS & REFUNDS

  • Bookings made through our website are final, with no refunds or exchanges

  • Your class, private or duet session, or workshop is not confirmed until payment is received and confirmed

  • All "packs" or "subscriptions" are non-refundable, non-changeable and not transferable to another person

STRICT CANCELLATION POLICY

Group Classes:

  • Cancellations must be made at least 6 hours before the scheduled class time

  • Late cancellations (less than 6 hours notice) will incur full payment

  • No-shows will be charged the full class fee

  • There are no refunds for missed classes

Private or Duet Sessions:

  • A full 24 hours notice is required for cancellation

  • Cancellations made less than 24 hours before the appointment will be charged the full session fee

  • No-shows will be charged the full session fee

CLASSES

  • Classes are scheduled for 50 minutes unless otherwise stated

  • Classes take place at times and dates in our schedule (subject to change with notice)

  • All classes will be at our Studio location unless notified otherwise

  • Arriving on time is essential; we recommend coming early to account for delays

  • Late arrivals will not receive extended session time or refunds

  • You may not assign your place to another person

  • Leaving our studio or classes at any time means forfeiting unused sessions in your pack

  • All clients must complete a health waiver form before the first session, update it yearly, and inform us immediately of any health status changes

GROUP MEMBERSHIP DETAILS

  • Membership is a 4-weekly (28 days) rolling arrangement with automatic payment

  • Your enrollment date becomes your payment date every four weeks (28 days)

  • You must maintain an active card on your online account

  • There is a 4-month minimum contract (subject to change)

  • We aim to operate 52 weeks per year, with some skeleton or online schedules

  • If your teacher is unavailable, we will try to provide an alternative teacher or reschedule

  • We reserve the right to cancel any class with fewer than 2 participants

  • Membership can be paused for illness or injury at our discretion for a £15 admin fee

  • You may "Pause" one payment month per calendar year for extended holidays with 1 month's notice

  • To cancel your membership, provide 1 full month's notice in writing

  • Persistent no-shows or late cancellations may result in loss of membership

  • Our membership rates offer the lowest prices compared to pack or pay-as-you-go options

WHAT TO BRING

  • For group mat classes, we supply mats and small equipment

  • Clean socks are required for hygiene reasons

  • Please bring your own water bottle, although water and cups are provided if necessary.

NOISE LEVELS

  • Please keep noise to a minimum when entering and leaving the building

DATA PROTECTION

  • We comply with data protection laws regarding your personal data

INTELLECTUAL PROPERTY

  • We own or license all Intellectual Property Rights in our materials and content

  • You may not copy, reproduce, publish, share, sell, or make available to others any content used in classes/videos

  • We grant you a limited, non-exclusive license to use content only for the purpose of the classes

  • Audio/visual recordings of classes require our prior written consent

  • We may make recordings of classes with your permission

LIABILITY RELEASE

I understand that:

  • My teacher is a qualified and insured Pilates teacher

  • Lytham Pilates is not responsible for safekeeping personal belongings

  • I will inform the teacher of anything painful/unusual experienced during or between classes

  • I will stop exercises if needed or follow alternatives provided

  • My teacher may offer professional advice and consider it unprofessional to continue teaching if I don't follow that advice

  • I will keep my teacher updated on changes in my medical condition

  • All exercise carries risk, and I participate voluntarily with knowledge of potential personal injury, property loss, or death

  • I agree not to sue Jessica Fell, Lytham Pilates, its instructors, or members for personal injury, property damage/loss, or wrongful death

  • I have either received doctor's permission to participate or assume all responsibility for participation without approval

  • I will alert the instructor of any problems or concerns so modifications can be made

  • Classes may involve hands-on correction and I consent to this approach

  • Instructor changes may occur without refund; cancelled classes will receive full refund

  • Lytham Pilates and Jessica Fell are not responsible for injuries from live online or pre-recorded content

  • Pregnancy must be disclosed for appropriate exercise modifications

LIABILITY – IMPORTANT NOTICE

  • Nothing in this agreement limits liability for death or personal injury caused by negligence, fraud, or matters that cannot legally be excluded

  • Services will be provided with due care, skill, and ability

  • All other warranties and representations are excluded to the extent permitted by law

  • You must disclose any medical conditions that may affect participation

  • We are not liable for loss of profits, business, goodwill, anticipated savings, goods, contracts, data corruption, or any special, indirect, consequential losses

  • We are not liable for delays or prevention of performance due to your actions or circumstances beyond our control

  • These liability provisions survive termination of this agreement

GENERAL

This agreement and any disputes arising from it shall be governed by English law, with exclusive jurisdiction granted to the courts of England and Wales.
